NOTICE OF SHERIFF’S SALE UNDER JUDGMENT AND DECREE

and John Doe, Mary Roe, and XYZ corporation,

Defendants.

NOTICE IS HEREBY GIVEN that, under, and by virtue of, that certain amended findings of fact, conclusions of law, order for judgment and judgment dated January 28, 2013, and filed on February 1, 2013 (“Order”), a certified copy of which has been delivered to me directing the sale of the Property, as hereinafter described, to satisfy the amount found and adjudged due to said Plaintiff in the above-entitled action from Defendant, Beeksma Properties, LLC, a Minnesota limited liability company (“Beeksma”), as prescribed in the Order, with respect to that certain real estate mortgage executed by Beeksma, in favor of RiverBank, dated May 8, 2006, and recorded on June 6, 2006, as Document No. A469943, as assigned to Central Bank, a Minnesota banking corporation, pursuant to that certain Receiver’s Assignments of Note, Mortgage and Assignment of Rents dated February 9, 2012, and recorded on February 17, 2012, as Document No. A541548, all  in the Office of the County Recorder in and for Chisago County, Minnesota, the undersigned Sheriff of Chisago County, Minnesota, shall sell at public auction, to the highest bidder, for cash, on the 26th day of April, 2013, at 10:00 a.m., Chisago County Government Center, 313 North Main Street, Center City, Minnesota 55012, in the said County and State, the following premises and real estate described in said Order, commonly known 345 Summit Avenue, PID No.12-0041-00, and legally described as follows:

That part of Government Lot Five (5) of Section Thirty-four (34), Township Thirty-four (34) North, Range Twenty (20) West, Chisago County, Minnesota, described as follows:

Commencing at the northeast corner of said Section 34; thence South 00 degrees 57 minutes 52 seconds East, assumed bearing, along the east line of said Section 34, a distance of 2366.65 feet; thence South 75 degrees 23 minutes 21 seconds West, a distance of 143.75 feet to the point of beginning; thence South 09 degrees 58 minutes 16 seconds East, a distance of 12.00 feet; thence South 80 degrees 01 minute 44 seconds West, a distance of 20.00 feet; thence South 20 degrees 01 minute 44 seconds West, a distance of 57.74 feet; thence North 80 degrees 01 minute 44 seconds East, a distance of 181.93 feet to said east line of said Section 34; thence North 02 degrees 04 minutes 19 seconds West along said east line, a distance of 62.59 feet to the intersection with a line bearing North 80 degrees 01 minute 44 seconds East from said point of beginning; thence South 80 degrees 01 minute 44 seconds West, a distance of 141.66 feet to said point of beginning (“Property”).

THE TIME ALLOWED BY LAW FOR THE REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTE § 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
