NOTICE IS HEREBY GIVEN, that under and by virtue of the Order for Judgment and Decree (the “Order”) entered in the above entitled action on the 14th day of September, 2012, by the District Court of Chisago County, Minnesota, Tenth Judicial District, a certified copy of which has been delivered to me directing the sale of the premises hereinafter described, to satisfy the amount due to plaintiff in the above entitled action from defendants above named, as prescribed in the Order, the undersigned Sheriff of Chisago County will sell at public auction, to the highest bidder, for cash, on the 29th day of March, 2013 at 10:00 a.m. at the Chisago County Sheriff’s Department, located at 313 North Main Street, Room 100, Center City, MN 55012, the premises and real estate, lying and being in the County of Chisago, State of Minnesota, to wit:
The Southwest Quarter of the Southeast Quarter of Section 8, Township 33 North, Range 21 West, Chisago County, Minnesota.
An Easement and right-of-way for road or trail purposes, over and across the following described lands: The West 66 feet and the South 80 feet of the West 990 feet all of the Southwest Quarter of Northeast Quarter, Section 8, Township 33 North, Range 21 West. Together with that part of said Southwest Quarter of Northeast Quarter, lying Southwesterly of a curve concave to the Northeast having a radius of 200 feet. The East line of said West 66 feet and the North line of said South 80 feet are tangent to said curve.
A non-exclusive perpetual easement for roadway, access, ingress, egress and utility purposes over, under and across the following described parcel: The South 50 feet of the West 86 feet of the Northwest Quarter of Northeast Quarter, Section 8, Township 33 North, Range 21 West.
An ingress and egress easement over the Westerly 66 feet of the West half of the East half of the Northwest Quarter of the Southeast Quarter, Section 8, Township 33 North, Range 21 West, Chisago County, Minnesota.
(hereinafter the “Mortgaged Property”).
The Mortgage was dated August 17, 2007 and recorded October 15, 2007 as Document No. A-491174 in the original principal amount of $200,000.00 between DJ Land Development, LLC and Patriot Bank Minnesota. The Mortgage was subsequently assigned to First Resource Bank by Assignment recorded May 8, 2012 as Document No. A-544254.
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED. IF PART OF THE PROPERTY TO BE SOLD CONTAINS YOUR HOUSE, YOU MAY DESIGNATE AN AREA AS A HOMESTEAD TO BE SOLD AND REDEEMED SEPARATELY.
YOU MAY DESIGNATE THE HOUSE YOU OCCUPY AND ANY AMOUNT OF THE PROPERTY AS A HOMESTEAD, THE DESIGNATED HOMESTEAD PROPERTY MUST CONFORM TO THE LOCAL ZONING ORDINANCES AND BE COMPACT SO THAT IT DOES NOT UNREASONABLY REDUCE THE VALUE OF THE REMAINING PROPERTY.
YOU MUST PROVIDE THE PERSON FORECLOSING ON THE PROPERTY, THE SHERIFF, AND THE COUNTY RECORDER WITH A COPY OF THE LEGAL DESCRIPTION OF THE HOMESTEAD YOU HAVE DESIGNATED BY TEN BUSINESS DAYS BEFORE THE DATE THE PROPERTY IS TO BE SOLD.
