Pry marks were visible on the door to a house and the door frame was damaged where a burglary was reported July 21. No details about what was stolen. The location was on Birch Ave. in Nessel Township.

Two underage drinkers were cited July 20 for consumption at the County Fair Beer Garden in Rush City.

July 19 there were reports of grafitti vandalism done to the elementary school in Rush City.

There were two fires; one July 15 in Rush City and one in Sunrise July 17. A dryer caught fire in Rush City about 7:30 a.m. at a home on West 9th St. Rush City Fire Dept. removed the appliance and handled the incident. The second was reported about 3:30 a.m. at an house on Holman Ave. No details were available.

July 17 a visitor to Interstate Park had a purse and wallet stolen from a car overnight. The report was filed at 8:30 a.m. and by 9 a.m. there was already action on the stolen credit card, with a $374 purchase made at Forest Lake Wal Mart.

July 16 a Lent Township (Falcon Ave.) homeowner reported he was watching T.V. about 1 a.m. and a crowbar came crashing through a sliding glass door. Crowbar is being held for evidence.

Technicality not enough to get sentence reviewed

A Rush City Prison inmate who appealed some of his prison sentence, based on a verbal error by a local district judge, was denied this week by the Minnesota Court of Appeals. Michael Carlton Lowe sr. age 40, is being incarcerated until 2027. As he was committed to the Commission of the Dept. of Corrections for 360 months by Judge John McBride in 2007, Lowe claims the sentencing statement was not proper.

Three petitions for a hearing were then denied. Lowe had been convicted of first degree criminal sexual conduct and third degree assault and terroristic threats. But Lowe claims his restraint was illegal because the judge didn’t grant an evidentiary hearing. Lowe petitioned for writ of habeus corpus three times. The Appeals judges agreed the local district court was correct in denying the hearings.

The petitioner did not demonstrate a factual dispute in the sentencing and further, the appeals judges said post conviction issues can’t be remedied in this type of hearing. The judge had mis-spoke when sentencing and uttered the word “probation” even though the court understood what the sentence to be. “No relevant facts concerning his sentence are in dispute,” the appeals court decision explained.
